An Analysis of Legal Challenges and Solutions for the Implementation of Artificial Intelligence in Iran’s Administrative System

The implementation of artificial intelligence (AI) in Iran’s legal and administrative systems represents a critical contemporary challenge that requires the development of specific legal frameworks adapted to the country's socio-cultural and institutional context. This study seeks to answer the fundamental question: How can Iran’s administrative legal system effectively and safely implement AI technology, and what legal challenges, opportunities, and solutions exist in this process? The findings indicate that the absence of specialized legislation, ambiguity in assigning responsibility for decisions made by intelligent systems, threats to privacy and personal data, and the risk of discrimination and human rights violations are among the major barriers to AI integration in Iran’s public administration. Conversely, AI offers opportunities such as enhanced efficiency, increased transparency, reduced administrative corruption, and improved public services. To realize these benefits and mitigate potential harms, the study proposes several legal and policy measures, including: developing comprehensive and adaptive legislation on accountability, data protection, and citizens’ rights; establishing independent oversight bodies; continuous monitoring of algorithmic performance; conducting legal and social impact assessments; fostering public awareness and specialized training for managers and judges; and leveraging the legal experiences of leading countries. Ultimately, the study concludes that the responsible and successful implementation of AI in Iran’s administrative structure requires a fundamental revision of legal policymaking, targeted legislation, and the establishment of institutional and regulatory infrastructures aligned with technological advancements.
