fa مبارزه با فساد مالی؛ آسیب‌شناسی صلاحیت‌های دیوان عدالت اداری و سازمان بازرسی کل کشور تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span b="" lang="AR-SA" mitra="" style="font-family:"><span style="color:black">فساد مالی تقدم منافع خصوصی بر منافع عمومی و نوعی سوءاستفاده از قدرت و اختیارات قانونی به&shy;منظور تأمین منافع شخصی است که عوامل مختلفی مانند عدم نظارت مطلوب می&shy;تواند در ایجاد آن مؤثر باشد. سؤال این است که آیا دستگاه&shy;های نظارتیِ قوه قضائیه می&shy;توانند در پیدایش یا گسترش فساد مالی نقش داشته باشند؟ با استفاده از منابع کتابخانه&shy;ای و به روش توصیفی و تحلیلی ضمن پاسخ مثبت به سؤال مذکور گفته شده باید مراجع نظارتی آسیب&shy;شناسی شوند؛ زیرا نظارت دیوان عدالت اداری و سازمان بازرسی کل کشور به&shy;نحو مطلوب صورت نمی&shy;گیرد؛ از یک طرف نظارت دیوان موکول به طرح دعوی اشخاص حقوق خصوصی و عمدتاً حول محور دعوای ابطال می&shy;باشد ضمن این&shy;که دیوان در رسیدگی به دعاوی اداری صلاحیت عام نداشته و تبصره ماده 12 قانون دیوان دایره&shy;ی رسیدگی این نهاد را محدود نموده است از طرف دیگر نظارت سازمان بازرسی کل کشور از جهت ضمانت اجرا ضعیف و وابستگی آن به قوه قضائیه محل تأمل می&shy;باشد، همچنین ارائه گزارش به مقامات ذیصلاح توسط سازمان مزبور با نظارت موردنظر قانونگذار اساسی فاصله معناداری دارد که برای رفع این مشکلات بازطراحی ساختار و صلاحیت مراجع نظارتی با تأکید بر نظارت خودکار ضرورت دارد و گرنه خود نهادهای نظارتی معیوب عاملی در جهت کمک به گسترش فساد است.</span></span></span></span></span></span><br> &nbsp;
