fa «چالش‌ها و فرصت‌های تحول دیجیتال در اجرای اصل لزوم ارائه دلایل در حقوق اداری» Challenges and Opportunities of Digital Transformation in Implementing the Duty to Give Reasons in Administrative Law تخصصي Special پژوهشي Research اصل لزوم ارائه دلایل تصمیمات اداری به عنوان رکنی اساسی در حقوق اداری، شفافیّت و پاسخگویی نهاد‌های عمومی را تضمین می‌نماید. این پژوهش با این سؤال که «تحول دیجیتال چه چالش‌ها و فرصت‌هایی را برای اجرای اصل لزوم ارائه دلایل در حقوق اداری ایجاد می‌نماید؟» به بررسی تأثیرات تحول دیجیتال بر این اصل پرداخته و با روش توصیفی- تحلیلی، چالش‌ها و فرصت‌های تحول دیجیتال را در چارچوب اتحادیه اروپا تحلیل می‌نماید. چالش‌ها شامل: «الگوریتم‌های غیرشفاف، ناهماهنگی‌های حقوقی، مقاومت سازمانی، و نابرابری دسترسی» هستند که از پیچیدگی‌های فنی تا شکاف‌های اجتماعی را دربرمی‌گیرند. در مقابل، فرصت‌ها شامل: «تقویت شفافیّت، بهبود دسترسی عادلانه، کاهش خطا‌های انسانی، و تسهیل نظارت قضایی و شهروندی» است. فناوری‌هایی مانند هوش مصنوعی قابل تفسیر و پلتفرم‌های چند زبانه، با طراحی‌های تطبیقی، تجربه کاربری را برای گروه‌های متنوع بهینه‌سازی نموده و اعتماد عمومی را افزایش می‌دهند. با این حال، محدودیت‌هایی مانند کمبود زیر ساخت‌های دیجیتال در مناطق محروم و نیاز به سواد دیجیتال، مانع تحقق کامل این اصل در فضای الکترونیک شده است. این تجربیات، با توجه به چالش‌های مشترک دیجیتالی شدن نظام‌های اداری، مانند نیاز به زیرساخت‌های دیجیتال و سواد فناوری، می‌تواند اصلاحات حقوقی و فنی در ایران را هدایت نماید. تقویت اجرای اصل لزوم ارائه دلایل تصمیمات اداری در عصر تحول دیجیتال نیازمند سیاست‌گذاری‌های هماهنگ و سرمایه‌گذاری در فناوری‌های نوین می‌باشد.   The duty to give reasons for administrative decisions is a fundamental principle in administrative law that ensures transparency and accountability of public institutions. This study explores the impact of digital transformation on the implementation of this principle by addressing the question: "What challenges and opportunities does digital transformation pose for the implementation of the duty to give reasons in administrative law?" Using a descriptive-analytical method, it examines the challenges and opportunities of digital transformation within the framework of the European Union. The challenges include opaque algorithms, legal inconsistencies, institutional resistance, and unequal access, encompassing both technical complexities and social disparities. In contrast, the opportunities involve enhanced transparency, improved equitable access, reduced human error, and facilitated judicial and civic oversight. Technologies such as interpretable artificial intelligence and multilingual platforms, when designed adaptively, optimize user experience for diverse groups and build public trust. However, limitations such as the lack of digital infrastructure in underprivileged areas and the need for digital literacy hinder the full realization of this principle in digital environments. These experiences, considering the shared challenges of administrative digitalization—such as the need for infrastructure and technological literacy—can inform legal and technical reforms in Iran.
