fa رویۀ قضایی دیوان‌عدالت‌اداری در دعاویِ مربوط به تغییر صندوق ‌بازنشستگیِ کارکنانِ بنگاه‌های واگذارشده تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span b="" lang="AR-SA" mitra="" style="font-family:">خصوصی</span>‌<span b="" lang="AR-SA" mitra="" style="font-family:">سازیِ ایرانی و واگذاری بنگاه‌های دولتی به بخش‌خصوصی، از زوایای گوناگون‌ حقوقی، اقتصادی و سیاسی قابل تحلیل و بررسی است؛ اما یکی از مسائل نو که به آن کمتر پرداخته شده و موضوع مقاله حاضر است، وضعیت حقوقیِ کارکنان بنگاه‌های واگذارشده، پیروی اجرای سیاست&shy;</span>‌<span b="" lang="AR-SA" mitra="" style="font-family:">های کلی اصل 44 قانون اساسی و قوانین مؤخر بر آن هست. بررسی برخی دعاوی و رویۀ مراجع حل اختلاف کار و دیوان عدالت اداری در باب آنها، حاکی از آن است که برخی از بنگاه‌های واگذارشده با بی‌اعتنایی به وضعیت حقوقیِ جدید کارکنان خود در قالب &laquo;کارگر&raquo; و نقضِ قواعد حاکم بر خصوصی&shy;سازی، موجب اخلال در وضعیت بیمه‌ای کارکنان خود و بروز دعوا و اختلاف اداری گردیده‌اند. این پژوهش با روش تحقیق توصیفی-تحلیلی و گردآوری اطلاعات به شیوۀ کتابخانه‌ای، به نقد و بررسی رویۀ قضایی شعب و هیأت عمومی دیوان‌عدالت‌اداری در باب این دعاوی پرداخته و ضمن تحلیل قواعدحقوقیِ حاکم بر قضیه و تأکید بر حقِ بر تأمین‌اجتماعی، به این رهیافت رسیده که حداقل‌حق‌قانونیِ کارکنان بنگاه&shy;های واگذارشده در حوزۀ بیمه‌ای، ابقاء بر صندوق بیمه&shy;گرِ سابق با اِعمال مقررات قانون تأمین اجتماعی است؛ گرچه قواعد اخیرالتّصویب، تغییر صندوق و نقل و انتقال سوابق بیمه‌ای را نیز تحت شرایطی مجاز دانسته است. </span></span></span></span></span><br> &nbsp; <span style="font-size:10.0pt"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif">The privatization in Iran and transfer of state-owned </span></span></span><span style="font-size:10.0pt"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif">corporations</span></span></span><span style="font-size:10.0pt"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif"> to private sector can be analyzed from various legal, economic, and political perspectives, But one of the new issues that has received less attention and is subject of this article is the legal status of employees of the privatized </span></span></span><span style="font-size:10.0pt"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif">corporations</span></span></span><span style="font-size:10.0pt"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif"> by implementation of the general policies of Article 44 of the Constitution and subsequent laws related to them.
