	<abstract_fa>&lt;span style=&quot;font-size:11pt&quot;&gt;&lt;span style=&quot;text-justify:kashida&quot;&gt;&lt;span style=&quot;text-kashida:0%&quot;&gt;&lt;span style=&quot;direction:rtl&quot;&gt;&lt;span style=&quot;unicode-bidi:embed&quot;&gt;&lt;span new=&quot;&quot; roman=&quot;&quot; style=&quot;font-family:&quot; times=&quot;&quot;&gt;&lt;span b=&quot;&quot; lang=&quot;FA&quot; mitra=&quot;&quot; style=&quot;font-family:&quot;&gt;&lt;span style=&quot;color:black&quot;&gt;این مقاله برای پاسخ به پرسش در مورد چگونگی تبیین تعهدات دولت به فقرزدایی در قانون اساسی جمهوری اسلامی ایران از منظر نظریه عدالت جان رالز، به تحلیل تطبیقی این تعهدات با این نظریه مورد اشاره می&#8204;پردازد. فقر و نابرابری از چالش&#8204;های اساسی جامعه ایران است و قانون اساسی، به&#8204;ویژه در اصول سوم، بیست و نهم، سی و یکم و چهل و سوم، تعهدات روشنی برای رفع آن و تأمین نیازهای اساسی شهروندان مقرر کرده است. پژوهش حاضر با بهره&#8204;گیری از چارچوب نظری &amp;laquo;عدالت به&#8204;مثابه انصاف&amp;raquo; رالز و مفاهیم کلیدی آن مانند &amp;laquo;اصل تفاوت&amp;raquo; و &amp;laquo;برابری منصفانه فرصت&#8204;ها&amp;raquo;، به ارزیابی مبانی و ابعاد این تعهدات می&#8204;پردازد. فرضیه مقاله به این شکل قابل صورت&#8204;بندی است که علیرغم وجود شباهت&#8204;های سطحی بین نظریه رالز و مفاد قانون اساسی جمهوری اسلامی ایران، تعارضات بنیادین ماهوی، حجیت نظریه رالز را به عنوان ابزاری برای تحلیل حقوقی تعهدات دولت به فقرزدایی در قانون اساسی جمهوری اسلامی ایران، در حد بسیار زیادی کاهش می&#8204;دهد. روش تحقیق، توصیفی-تحلیلی و مبتنی بر مطالعه اسنادی است. یافته&#8204;ها نشان می&#8204;دهد که میان دو دیدگاه، همگرایی&#8204;های قابل&#8204;توجهی در اهداف کلی مانند تأکید بر بهبود وضعیت محروم&#8204;ترین اقشار جامعه، تأمین نیازهای اساسی، ایجاد فرصت&#8204;های برابر و پذیرش نقش فعال دولت در بازتوزیع ثروت وجود دارد. با این وجود، تفاوت&#8204;های بنیادینی نیز مشاهده می&#8204;شود که مهم&#8204;ترین آن، مبنای هستی&#8204;شناختی است؛ قانون اساسی بر پایه اصول الهی و اسلامی استوار است، درحالی&#8204;که نظریه رالز بر یک قرارداد اجتماعی سکولار و عقلانی بنا شده است. این تفاوت منجر به رویکردهای متمایز در اولویت&#8204;بندی آزادی&#8204;های اساسی، ماهیت دولت و حدود اختیارات آن در محدود کردن حقوق فردی به نفع مصالح عمومی می&#8204;گردد.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;br&gt;

It seeks to answer the question of how the state&amp;rsquo;s obligations for poverty eradication are explained in the Constitution from the perspective of Rawls&amp;rsquo;s theory. Poverty and inequality constitute fundamental challenges for Iranian society. The Constitution, particularly in Articles 3, 29, 31, and 43, mandates clear obligations for addressing these issues and securing citizens&amp;#39; basic needs. This research utilizes Rawls&amp;rsquo;s &amp;quot;Justice as Fairness&amp;quot; theoretical framework and its key concepts, such as the &amp;quot;Difference Principle&amp;quot; and &amp;quot;Fair Equality of Opportunity,&amp;quot; to evaluate the foundations and dimensions of these constitutional commitments. The article&amp;rsquo;s hypothesis is formulated as follows: Despite the existence of superficial similarities between Rawls&amp;#39;s theory and the provisions of the Constitution of the Islamic Republic of Iran, fundamental substantive conflicts significantly reduce the theoretical utility of Rawls&amp;#39;s theory as a legal analytical tool for examining the state&amp;#39;s poverty eradication obligations under the Iranian Constitution. The research method is descriptive-analytical and relies on documentary study. The findings indicate significant convergences between the two viewpoints in their overarching goals, including an emphasis on Improving the condition of the least advantaged members of society,&amp;nbsp; Providing basic needs, Creating equal opportunities, and&amp;nbsp; Accepting an active role for the state in wealth redistribution. Nevertheless, fundamental divergences are also observed, the most important of which is their ontological basis: the Constitution is founded on divine and Islamic principles, whereas Rawls&amp;rsquo;s theory is built upon a secular and rational social contract. This difference leads to distinct approaches concerning the prioritization of basic liberties, the nature of the state, and the scope of its authority to restrict individual rights in favor of the public interest.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;br&gt;
