fa نظارت قضایی دیوان عدالت اداری بر مصوبات مجمع تشخیص مصلحت نظام، مجلس خبرگان و شورای نگهبان The Judicial Review of the Administrative Justice Court on the Nation's Exigency Council, Experts Parliament and Guardian Council's Regulations تخصصي Special پژوهشي Research در نظام حقوقی ایران همواره یکی از مسائل اختلافی، بحث در مورد صلاحیت هیأت عمومی دیوان عدالت اداری در نظارت بر تصمیمات مراجع مختلف از جمله مجمع تشخیص مصلحت نظام، شورای نگهبان و مجلس خبرگان بوده است. این نهادها با اتکاء بر وظایف ذاتی خود و در خلال آن، به وضع تصمیماتی مبادرت میکنند که برخی از آنها ماهیتاً صبغهای اداری دارند. با عنایت بر رویهی دیوان در نوع نگاه به تصمیمات این مراجع، هدف این نوشتار آن است که علاوه بر تبیین حوزهی صلاحیت مقررهگذاری، با تعریفی اجمالی از اعمال سیاسی، قضایی، تقنینی و اداری، به بررسی وظایف نهادهای مارالاشعار پرداخته و پیشفرض را بر این گذارده است که اعمال اداری آنها میتواند موضوع بازنگری قضایی باشد. چرا که به تعبیری، دیوان عدالت اداری به عنوان یک نهاد عالی قضایی دارای صلاحیت عام و ذاتی در رسیدگی به دعاوی اداری است. از اینرو، تبصرهی مادهی 12 قانون دیوان قابل انتقاد به نظر میرسد و اصل نظارتپذیری قدرت که ارتباط وثیقی با تضمین اصل حاکمیت قانون دارد، خروج بیدلیل عموم مصوبات این نهادها را از حوزهی صلاحیت هیأت عمومی بر نمیتابد. مضافاٌ؛ چنین استثنائاتی بر صلاحیت هیأت عمومی، یقیناً نقض حق افراد در دسترسی به مراجع صالح قضایی است. Considering the procedure of the type of attitude towards the decision of these bodies, the purpose of this article accordingly that in addition to clarifying the scope of jurisdiction rule-making of the legal system with a brief definition from political action, judicial action, legislative action and administrative action to review the duties of these institutions and assume that their administrative actions can be subject to judicial review. Because in terms of administrative Justice court, as a supreme judicial institution, has general qualification in administrative claims.
