fa نقدی بر نظر شورای نگهبان در مورد توسعه مقامات مذکور در اصل 142 قانون اساسی تخصصي Special پژوهشي Research <p><span style="font-size:11pt">مقابله با فساد مالی مسئولان از موضوعات مهم حقوقی است که بخش‌هایی از آن در حقوق اداری بحث می‌شود. در این راستا قانون اساسی جمهوری اسلامی ایران در اصل 142 رسیدگی به دارایی برخی از مقامات عالی‌رتبه کشوری را بر عهده رئیس قوه قضاییه قرار داده است. از آنجایی‌که تجربه نشان داده است فساد مالی در مقامات مادون بیشتر رخ می‌دهد، نمایندگان مجلس شورای اسلامی در چهار مورد کوشیدند تا نظارت موردنظر در اصل 142 قانون اساسی را به سایر مقامات و مدیران کشوری و لشکری تسری دهند، ولی با ایراد شورای نگهبان مبنی بر حصری بودن مقامات مذکور در اصل 142 قانون اساسی مواجه شدند. در نهایت مجلس شورای اسلامی این مصوبه را به مجمع تشخیص مصلحت نظام ارجاع کرد و این مرجع نیز با اصلاحات کلی مصوبه مجلس را تأیید نمود. این پژوهش با روش توصیفی &ndash; تحلیلی به دنبال بررسی امکان یا عدم امکان مقررات‌گذاری مجلس شورای اسلامی در خصوص توسعه مقامات مذکور در اصل 142 قانون اساسی است. در این راستا در این پژوهش دلایل مخالفان توسعه مقامات مذکور در اصل 142 قانون اساسی پاسخ داده شده و به این نتیجه می‌رسیم که بنا بر دلایل قانونی و شرعی و استفاده از شیوه تفسیری غایی مجلس شورای اسلامی صلاحیت تصویب قانون برای افزایش مقامات مذکور در اصل 142 قانون اساسی را دارد.</span><br> &nbsp;</p> <span style="font-size:10pt"><span style="line-height:normal"><span new="" roman="" style="font-family:" times=""><span lang="EN" style="font-size:11.0pt">Combating financial corruption of officials is one of the important legal issues, parts of which are discussed in administrative law.</span> <span lang="EN" style="font-size:11.0pt">According to Article 142 of the Constitution of the Islamic Republic of Iran, the head of the judiciary oversees the property of some officials.</span> <span lang="EN" style="font-size:11.0pt">As experience has shown that corruption is more prevalent among lower-ranking officials, members of the Islamic Consultative Assembly have struggled four times to extend the oversight referred to in Article 142 of the Constitution to other state and military officials and managers, but </span><span lang="EN" style="font-size:11.0pt">they were confronted with the objection of the Guardian Council that the mentioned authorities are in principle 142 restricted. Finally, the Islamic Consultative Assembly sent this law to the Expediency Discernment Council, and that Council, with general amendments, approved the Assembly&#39;s opinion. This descriptive-analytical study seeks to examine the possibility or impossibility of regulating the Islamic Consultative Assembly regarding the development of the authorities mentioned in Article 142 of the Constitution.
