fa چالش‌های مداخله کیفری قضایی در وضعیت تعارض منافع در نظام اداری ایران تخصصي Special پژوهشي Research <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><span style="font-size:14.0pt">مقامات عمومی در اجرای وظایف خود، با انگیزه‌ها، باورها و علایق پیچیده‌ای مواجه هستند که به طور بالقوه می&shy;تواند ایشان را از اجرای وظایف خود منحرف</span> <span style="font-size:14.0pt">کند. وضعیت تعارض منافع در نظام اداری، حتی اگر موجب ترجیح منفعت شخصی نشود، باعث تضعیف کارایی مقام عمومی خواهد شد که یکی از نتایج آن، خدشه به مشروعیت دستگاه حاکم خواهد بود؛ از این&shy;رو، پیشگیری و کنترل وضعیت تعارض منافع ضروری خواهد بود. این درحالی&shy;است که مداخله‌های کیفری سنتی، توان کنترل این وضعیت را نداشته&shy;اند. این پژوهش به دنبال بررسی چالش‌های مداخله کیفری قضایی در وضعیت تعارض منافع در&nbsp; نظام اداری ایران است تا بتواند در تبیین الگویی جهت مداخله کیفری قضایی موثر در این وضعیت، ایفای نقش نماید. روش پژوهش حاضر، کیفی بوده و داده‌های آن از طریق مصاحبه با قضات مجتمع ویژه اقتصادی تهران و مشهد و وکلای فعال در حوزه جرایم اقتصادی (18 مورد) و سپس تحلیل و بررسی آرای مرتبط با وضعیت تعارض منافع به‌دست آمده است. یافته&shy;های این پژوهش نشان می&shy;دهد، نظام قضایی در مداخله موثر پیرامون وضعیت تعارض منافع در نظام اداری با چالش&shy;ها و خلأهای جدی، از جمله: فقدان سیاست جنایی منسجم، عدم</span><span style="font-size:14.0pt">‌</span><span style="font-size:14.0pt">شناخت مناسب و آموزش درخصوص این مفهوم، خلأهای قانونی، گزارش‌های مغرضانه، همچنین فقدان ابزار و بسترهای مناسب از جمله ضابطان آموزش‌دیده، عدم حمایت از گزارشگران فساد، فقدان شفافیت و نبود گزارش‌های دقیق برای کشف این وضعیت مواجه است. </span><span dir="LTR" style="font-size:14.0pt"><span style="font-family:IRLotus"></span></span></span></span><br> &nbsp;</p> <span style="font-size:11pt"><span style="line-height:normal"><span style="font-family:Calibri,sans-serif"><span style="font-size:12.0pt"><span garamond="" style="font-family:">Public officials face complex motives, beliefs, and interests in performing the duties that could potentially distract them from performing their duties. A conflict of interest situation, even if it does not lead to a preference for personal gain, will undermine the efficiency of the public authority, which in turn undermines the legitimacy of the ruling apparatus. Therefore, prevention and control of conflict of interest are essential, while traditional criminal interventions can not control this situation. This research seeks to investigate the challenges of judicial criminal intervention in a situation of conflict of interest in order to provide a model for effective criminal intervention in this situation. The research method is qualitative. The data were obtained through in-depth interviews with judges of the Tehran and Mashhad Special Economic Complex and lawyers active in the field of economic crimes (18 cases) and analysis content of verdicts related to the conflict of interest situation.
