fa آسیب‌شناسی ساختار و صلاحیت‌های هیأت مقررات‌زدایی و بهبود محیط کسب و کار تخصصي Special پژوهشي Research <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><span style="font-size:14.0pt">به استناد اصل 28 قانون اساسی، آزادی انتخاب شغل از حقوق بنیادین ملت ایران است. بر این اساس، قانون</span><span style="font-size:14.0pt">‌</span><span style="font-size:14.0pt">گذار عادی تلاش داشته با تأسیس هیأت مقررات‌زدایی‌ و بهبود محیط کسب و کار &nbsp;از این حق حمایت کند. این پژوهش</span> <span style="font-size:14.0pt">در قالبی توصیفی</span><span style="font-size:14.0pt">&ndash;</span><span style="font-size:14.0pt">تحلیلی تلاش کرده به این سؤال اصلی پاسخ گوید که ساختار و صلاحیت</span><span dir="LTR" style="font-size:14.0pt">‌</span><span style="font-size:14.0pt">های هیأت مقررات‌زدایی و بهبود محیط کسب و کار با چه چالش‌ها و موانعی روبه&shy;روست؟ یافته‌های تحقیق گویای آن است که ترکیب و جایگاه فعلی این هیأت، با وظایف و اختیارات آن تناسب ندارد و برگزاری منظم جلسات هیأت و الزام‌آوری مصوبات آن را با چالش مواجه کرده است؛ همچنین، برخی از صلاحیت‌های این هیأت به&shy;ویژه در حوزه نظارت بر مقررات مربوط به مجوزهای کسب و کار با صلاحیت</span><span dir="LTR" style="font-size:14.0pt">‌</span><span style="font-size:14.0pt">های سایر مراجع از جمله دیوان عدالت اداری، تداخل و همپوشانی دارد؛ بنابراین، پیشنهاد شد تا در صورت وجود اعتراض نسبت به مقررات در این حوزه، موضوع ابتدا در هیأت مقررات‌زدایی بررسی شود و درنهایت و در صورت نیاز، از آرای صادره از سوی هیأت در دیوان عدالت اداری اعتراض شود.</span></span></span><br> &nbsp;</p> <span style="font-size:11pt"><span style="unicode-bidi:embed"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span style="font-size:14.0pt"><span style="line-height:115%">According to Article 28 of the Constitution, the freedom to choose a job is one of the fundamental rights of the Iranian nation. Based on this, the regular legislator has tried to support this right by establishing a deregulation board and improving the business environment. This research, in a descriptive-analytical format, has tried to answer the main question, what are the challenges and obstacles faced by the structure and competences of the Board of Deregulation and Improvement of the Business Environment? The findings of this research show that the current composition and position of this board does not fit with its duties and competences and the regular holding of board meetings and the binding of its approvals have faced a challenge. Also, some of the competences of this board, especially in the field of monitoring regulations related to business licenses, overlap with the competences of other authorities, like the Administrative Justice Court.
