fa پیوند عقلانیت صوری و بوروکراسی؛ تولد حقوق اداری تخصصي Special پژوهشي Research <p dir="RTL" style="text-align:justify"><span style="font-size:11pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><a name="_Toc182137012"><span style="font-family:&quot;B Mitra&quot;">حقوقِ اداری، دانشی مدرن و برخاسته از تفکری نوین نسبت به جهان و انسان است. علاوه‌براین، حقوق اداری، حقوقی مضاف و تنظیم‌گر نظام اداری است. نظام اداری نیز به‌تبعِ پدیدارهای دیگر جهان، تحتِ تاثیرِ واقعۀ‌ مدرن، بسیار تحول یافت و شکل و شمایلِ جدیدی به خود گرفت. ادارۀ‌ مدرن، برمبنای اصول و شیوه‌های خاصی، نظامِ اجتماعی را مدیریت می‌کند. این اصول و شیوه‌ها در حقوق قابل ردیابی نیست؛ بلکه جلوه‌گاهِ نگاه و نگرشِ جدیدی به نظمِ اجتماعی است که اقتضائاتِ خاصی را با خود به‌دنبال داشته و حقوق و اداره را وادار به تغییر نموده است. آن نگرش را در جامعه‌شناسیِ حقوقِ ماکس وبر، عقلانیتِ صوری نام داده‌اند. عقلانیتِ صوری، نحوۀ ظهورِ نوین عقل است که جهان مدرن را دگرگون ساخته و نظامِ اجتماعی آن را به‌گونه‌ای سامان داده است که می‌بایست اداره‌ا‌ی مبتنی بر روشِ بوروکراتیک بر آن حکمفرما گردد و دانشِ حقوقی خاصی، این اداره را تنظیم و تنسیق نماید. بدین‌ترتیب، حقوقِ اداری، تحتِ تاثیرِ عقلانیتِ صوری، دلالت بر نوعِ خاصی از نظمِ اجتماعی دارد و تنها متکی به اصولِ حقوقی خویش نیست؛ بنابراین، فهم حقوق اداری، مستلزم درک جایگاه عقلانیت صوری در جهان مدرن و اقتضائاتِ آن برای حقوق اداری است. این‌گونه می‌توان متوجه شد که حقوق اداری، چگونه نظام اجتماعی را تنظیم می‌کند؟ </span></a></span></span></p> <span style="font-size:12pt"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><span style="font-size:11.0pt">Administrative law is a modern discipline that stems from a new way of thinking about the world and humanity. Furthermore, administrative law is an additional law that regulates the administrative system. The administrative system, like other phenomena in the world, has been greatly transformed by the modern era and has taken on a new shape and form. Modern administration, based on specific principles and methods, manages the social system. These principles and methods cannot be traced in law; rather, they are the manifestation of a new perspective and attitude towards social order, which has led to specific requirements and has forced law and administration to change. That attitude has been called formal rationality in Max Weber&#39;s sociology of law. Formal rationality is the way the new mind emerges; which has transformed the modern world and organized its social system in such a way that it must be governed by an administration based on the bureaucratic method, and a special legal knowledge regulates and harmonizes this administration. Thus, administrative law, under the influence of formal rationality, implies a certain type of social order and is not only based on its legal principles. Therefore, understanding administrative law requires understanding the place of formal rationality in the modern world and its requirements for administrative law.
