fa آسیب‌شناسی مشکلات شهری از منظر تخلفات حقوقی شهرداری‌ها؛ از علت‌شناسی تا راهبردهای مقابله (مطالعۀ موردی: شهرداری تبریز) تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span b="" lang="AR-SA" mitra="" style="font-family:">اختلافات قضایی بین شهروندان و شهرداری‌ها که عمدتاً ناشی از گستردگی و حجم تعاملات این نهاد با مردم است، به یکی از چالش‌های اساسی مدیریت شهری تبدیل شده است. این اختلافات که گاه از تخلفات شهرداری نشأت می‌گیرد، موجبات نارضایتی عمومی و اتلاف منابع ارزشمند این نهاد را فراهم کرده است. واکاوی این تخلفات از آن جهت حائز اهمیت است که پیامدهایی فراتر از دعوای فردی دارد و به تضییع حقوق شهروندان و خدشه‌دار شدن اعتماد عمومی به نهادهای حاکمیتی می‌انجامد. بر این اساس، شناسایی مصادیق اصلی تخلفات، تحلیل علل وقوع آن&shy;ها و در نهایت ارائه راهکارهای عملی برای پیشگیری و کاهش این موارد، گامی ضروری در جهت بهبود مدیریت شهری و تحقق حقوق شهروندی به شمار می‌آید. پژوهش حاضر با چنین رویکردی با بررسی پرونده&shy;محور به تبیین مهم&shy;ترین تخلفات شهرداری&shy;ها و علل آن&shy;ها و نهایتاً ارائه راهکار مناسب پرداخته است. این پژوهش به روش توصیفی و تحلیلی و پیمایشی و با گردآوری اطلاعات به صورت کتابخانه‌ای و میدانی، ضمن بررسی پرونده‌های مطروحه در کمیسیون تحقیق و تفحص شورای اسلامی شهر تبریز و با تهیه پرسشنامه و مصاحبه با شهروندان دارای اختلاف با شهرداری، درصدد آن است که مصادیق مهم تخلفات حقوقی شهرداری تبریز و علل و راهکارهای مقابله با آن را تبیین نماید. یافته&shy;های این پژوهش مؤید آن است که تعلل در رسیدگی به پرونده و پاسخ&shy;گویی، عدم اجرای آراء مراجع ذی‌صلاح، عدم اجرای تعهدات و مصالحه&shy;ها، عدم رعایت مقررات ساخت‌وساز از مهم&shy;ترین مصادیق تخلفات قابلِ انتساب به شهرداری هستند. اصلاح و شفاف نمودن قوانین و مقررات، ایجاد نهادهای نظارتی قوی و تأمین مالی شهرداریْ،&shy; پیشنهاد نگارنده جهت کاهش تخلفات حقوقی شهرداری است.</span></span></span></span></span><br> &nbsp; <span style="font-size:12pt"><span style="text-justify:kashida"><span style="text-kashida:0%"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span style="font-size:11.0pt"><span style="color:black">Legal disputes between citizens and municipalities, primarily arising from the extensive scope and volume of interactions between this institution and the public, have become one of the fundamental challenges in urban management. These disputes, sometimes stemming from violations committed by the municipality, have led to public dissatisfaction and the waste of the institution&#39;s valuable resources. Analyzing these violations is significant because their consequences extend beyond individual lawsuits, resulting in the infringement of citizens&#39; rights and the erosion of public trust in governmental institutions. Accordingly, identifying the main instances of violations, analyzing the causes of their occurrence, and ultimately providing practical solutions for preventing and reducing these cases constitute an essential step toward improving urban management and realizing citizens&#39; rights. The present study, with this approach and through a case-based examination, aims to explain the most significant violations by municipalities, their causes, and ultimately provide appropriate solutions. This research, employing a descriptive, analytical, and survey methodology, and gathering information through library and field studies, investigates cases brought before the Commission of Investigation and Inspection of the Tabriz City Council. By preparing questionnaires and conducting interviews with citizens in dispute with the municipality, it seeks to explain the important instances of legal violations by the Tabriz municipality, along with their causes and countermeasures. The findings of this research confirm that delays in processing cases and responding, non-enforcement of rulings by competent authorities, failure to fulfill commitments and settlements, and non-compliance with construction regulations are among the most significant instances of violations attributable to the municipality. Reforming and clarifying laws and regulations, establishing strong supervisory bodies, and securing municipal funding are the author&#39;s suggestions for reducing the municipality&#39;s legal violations.</span></span></span></span></span></span></span><br> &nbsp; تخلفات حقوقی, شهرداری, تبریز, حقوق شهری.
