fa کالبدشناسی فعالیت سیاسی کارکنان دستگاه‌های اجرایی در ایران؛ محدودیت یا ممنوعیت؟ تخصصي Special پژوهشي Research <span style="font-size:12pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span b="" lang="AR-SA" mitra="" style="font-family:"><span style="color:black">امکان انجام و مشارکت در فعالیت‌های سیاسی به عنوان حقی اساسی و در چارچوب حقوق سیاسی برای شهروندان در قانون اساسی به رسمیت شناخته شده‌ است. با این حال، استثنائاتی بر حق اعمال این فعالیت‌ها در زمانی که فردی در استخدام دستگاه و نهاد اجرایی است وجود دارد. این مقاله با روشی توصیفی- تحلیلی و با بهره‌گیری از اسناد و منابع کتابخانه‌ای به تحلیل قواعد حقوقی حاکم بر فعالیت سیاسی کارکنان دستگاه‌های اجرایی و نحوه اعمال حقوق سیاسی‌شان پرداخته و در پی پاسخگویی به این سوال است که محدوده فعالیت سیاسی کارکنان اجرایی در نظام حقوقی ایران تا به کجاست؟ بررسی‌ها نشان می‌دهد شمول محدودیت‌ها یا ممنوعیت‌ها بسته به اینکه کارکنان با چه مرتبه ای و در چه سازمانی مشغول به کارند متغیر است و دامنه آن از محدودیت فعالیت‌ها در ساعات اداری تا ممنوعیت مطلق حتی خارج از ساعات اداری در نوسان است. قوانین در ایران در این خصوص پراکنده‌اند و تصریح به فعالیت‌های سیاسی مجاز در قوانین به منظور ممانعت از تحدید غیرقانونی حق فعالیت سیاسی افراد، موضوعیست که مورد توجه قانونگذار در ایران قرار نگرفته است. احصای شمول محدودیت‌ها بدون تفسیر قوانین مرتبط درکنار یکدیگر و درنظرگرفتن عموم و خصوص آن‌ها امکان‌پذیر نیست</span></span><span dir="LTR" style="color:black">.</span><span b="" lang="AR-SA" mitra="" style="font-family:"><span style="color:black"></span></span></span></span></span></span><br> &nbsp; <span style="font-size:12pt"><span style="text-justify:kashida"><span style="text-kashida:0%"><span style="line-height:80%"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><span style="font-size:11.5pt"><span style="line-height:80%"><span style="color:black">The possibility of engaging in and participating in political activities is recognized as a fundamental right within the framework of political rights for citizens in the Constitution. However, there are exceptions to the right to engage in these activities when a person is employed by an executive agency or body. This article uses a descriptive-analytical method and uses documents and library resources to analyze the legal rules governing the political activity of employees of executive bodies and how to exercise their political rights. It seeks to answer the question of what is the scope of political activity of executive staff in the Iranian legal system. Studies show that the scope of restrictions or prohibitions varies depending on the rank of staffs and the organization they work for, and its scope ranges from restrictions on activities during office hours to absolute prohibitions even outside office hours. The laws in Iran are scattered in this regard, and specifying permitted political activities in the laws in order to prevent illegal restrictions on the right of individuals to engage in political activity is an issue that has not been addressed by the legislator in Iran.
