Judicial Procedure of Administrative Justice Court in the cases about the changing the retirement fund by Employees of Privatized corporations

The privatization in Iran and transfer of state-owned corporations to private sector can be analyzed from various legal, economic, and political perspectives, But one of the new issues that has received less attention and is subject of this article is the legal status of employees of the privatized corporations by implementation of the general policies of Article 44 of the Constitution and subsequent laws related to them. Examination of some cases and procedure of labor dispute authorities and Administrative Justice Court indicates that some privatized corporations with disregarding the new legal status of their employees as "worker" and violating from the rules about the privatization, have disrupted the insurance status of their employees that leading to disputes and administrative conflicts. This research by descriptive-analytical method and gathering information through library research, critiques and analyzes the judicial procedure of branches and general assembly of the Administrative Justice Court concerning these conflicts. The paper with study the legal rules that govern on the issue and emphasize on the right to social security, has been concluded that the minimum legal right of employees in privatized corporations is to remain under the previous insurance fund with applying the provisions of the Social Security Law; Although recent regulations under certain conditions also permit changing the fund and transfer insurance records
