The Iranian Legal System's Approach to Including Transferable Contribution Records of Government Employees as Effective Records in Retirement

In the Iranian administrative system, many employees may experience a change in pension fund due to a change in job or employment status. Therefore, in order to benefit from the effects of previous contribution records, they mainly want to transfer the records to the current pension fund and include them in the effective years in retirement. However, this issue faces conditions and limitations that are challenging in some cases. Given the importance of this issue, the current article, using a descriptive-analytical method and based on library studies, examines the conditions, effects, and limitations of including transferable insurance records of government employees in the Iranian administrative system. The findings of this article show that including previous government records as effective records in retirement years primarily requires the ability to transfer records, and if transferable, previous records are effective, as the case may be, in terms of the years required for retirement, the calculation of retirement pension, and the promotion of group or job rank. Also, the effect of these records on the years required for retirement is subject to the simultaneous existence of three government conditions: full-time and continuous, and the inclusion of these records in the effective years for retirement, in addition to legal conditions, has restrictions such as insurance to the destination pension fund for a certain number of years and the time of application for inclusion of contribution records; so that many government employees are deprived of including previous records as acceptable records for retirement years due to the lack of the above conditions or facing legal restrictions; as a result, legal reforms are necessary to overcome the current situation.
