An Analysis and Evaluation of the Internal and External Organizational Performance of the Administrative Justice Court
Hasan Khosravi , Mohmmadjavad Hoseini *
Abstract:   (19 Views)
Identifying and analyzing the internal and external organizational challenges of any institution contributes to a better understanding of its current conditions and facilitates efforts to improve its future performance. This study aims to identify the challenges facing Iran’s Administrative Justice Court, focusing not on judicial proceedings or the issuance of judgments, but rather on its organizational and administrative performance. To this end, the study adopts a descriptive-analytical approach, drawing on library-based research and a careful examination of the Court’s performance to review and analyze its internal and external organizational challenges across various dimensions. The findings indicate that although numerous shortcomings have been addressed in recent years through amendments to the law governing the Court and improvements in its management practices, the Court’s performance remains far from the desired standard of promoting and safeguarding citizens’ fundamental rights vis-à-vis public administration. The principal internal organizational challenges include shortcomings in the recruitment and employment of human resources, particularly judges; the high volume of incoming cases involving similar legal issues; shortages of personnel and the imbalance between staffing levels and caseloads; and the absence of systematic workload assessment and effective organizational information flow. The major external organizational challenges include inadequate public information and education regarding applicable laws; the failure of administrative bodies to implement the Court’s judgments properly and promptly; insufficient comprehensive oversight of the Court’s external collaborators; legal gaps concerning the eligibility of retired Court judges to practice law; and the multiplicity of regulatory authorities, coupled with the lack of prior coordination with the Court in the adoption of administrative regulations. Addressing these challenges requires appropriate measures and reforms to enhance the Court’s organizational effectiveness and strengthen the protection of citizens’ rights.
