Pathology of the Structure and Competencies of the Board of Deregulation and Improvement of the Business Environment

According to Article 28 of the Constitution, the freedom to choose a job is one of the fundamental rights of the Iranian nation. Based on this, the regular legislator has tried to support this right by establishing a deregulation board and improving the business environment. This research, in a descriptive-analytical format, has tried to answer the main question, what are the challenges and obstacles faced by the structure and competences of the Board of Deregulation and Improvement of the Business Environment? The findings of this research show that the current composition and position of this board does not fit with its duties and competences and the regular holding of board meetings and the binding of its approvals have faced a challenge. Also, some of the competences of this board, especially in the field of monitoring regulations related to business licenses, overlap with the competences of other authorities, like the Administrative Justice Court. Therefore, it was suggested that if there is an objection of the regulations in this field, at the first the matter should be reviewed in the Deregulation Board and finally, if necessary, the decisions issued by this Board should be appealed in the Administrative Justice Court.
