Principles and Requirements for Utilizing the Capacity of Artificial Intelligence in Iranian Administrative Law and the Legal System of the European Union

In recent decades, technological advancements– particularly in the field of artificial intelligence (AI) – have introduced new challenges and opportunities for legal systems. Administrative law, as a dynamic and functional branch within public law, faces an even greater need for efficiency, speed, transparency, and administrative justice than other legal domains. Accordingly, the use of AI in administrative processes – such as administrative decision-making, the provision of public services, oversight of proper law enforcement, and improvement of citizen–administration interactions – can be an effective step toward achieving good governance. Given the European Union’s structured and successful experience in regulating, supervising, and utilizing AI capacities in public administration, a comparative study in this area can provide a strategic model for Iran’s administrative legal system. The main concern of this research was to explore how AI can be employed in Iran’s administrative law by drawing on the principles, structures, and experiences of the European Union’s legal system. The findings of this research, conducted through a descriptive–analytical method, indicate that AI may be applied in areas such as repetitive administrative decision-making, processing large volumes of information, facilitating communication between citizens and administrative bodies, and enhancing the transparency of administrative performance. The European Union, through the adoption of regulations such as the AI Act and data protection laws (GDPR), as well as the formulation of ethical guidelines and establishment of specialized supervisory institutions, has designed a legal and operational framework for the responsible use of AI in public administration. The comparative analysis shows that Iran’s administrative legal system – by reforming and strengthening its legal and technical infrastructures – can benefit from the EU’s experiences in employing AI within administrative processes, particularly in areas like monitoring algorithm-based administrative decisions, ensuring data transparency, providing citizens with an effective right to appeal, and upholding human rights principles.
