Considering the inclusion of administrative law and, accordingly, the contracts of the country's technical and executive system, especially the construction order contracts on government companies as a part of the whole "Iranian government organizations" subject of Articles 1 to 5 of the Civil Service Management Law, it is necessary and necessary to recognize these companies Is. Because the use of construction order contracts and their referral with the tender method, not requiring or leaving formalities in the administrative system compared to the private sector (especially non-governmental companies) has different features, privileges and limitations. However, according to the existing definitions of the state company in the general laws and regulations of the country, as well as the investment or purchase of shares of some companies in the country by the state banks or their subsidiaries, the identification of these companies has been challenged. On the one hand, by becoming a company, it will be necessary to use government-approved construction order contracts (administrative contracts) as one of the most important types of contracts, especially in the civil and industrial fields, and these companies cannot use the freedom of action that the private sector has in drafting And their referrals are benefiting.
