Outsourcing the Provision of Public Services to Private Individuals (Government Service Centers) in Light of the Principles of Public Services

Nowadays, the provision of many public services by the government relies heavily on the use of communications and information technology. Examining the legal regime governing the public service centers involves their establishment, supervision, and duties as one of the tools of e-government, which requires understanding the foundations of e-government. Additionally, governments' considerations in outsourcing the provision of services to the private sector should be explored to ensure that the legal documentation for outsourcing public services to public service centers is justified. Public service centers in the administrative law of Iran have faced two regulatory models: the Cabinet has delegated its authority to a committee of ministers, and the committee, by approving the "Regulations for the Establishment and Operation of Government Service Centers and Non-Government Public Service Centers" in 2010, detailed regulations. In the next model, the government, through a resolution, mandated the Communications Regulatory Authority to issue a licensing decree, and detailed regulations can be found in the set of guidelines and regulations of this organization in 2017. Using a descriptive-analytical method, we seek to answer the question of what relationship the provision of public services electronically by private individuals has with the theory of public services and the governing principles. It seems that the principles governing public services also apply to electronic public services, and there is no conflict between the need for administrative system transformation and the principles of public services, allowing the private sector (government service centers) to provide services under government supervision.
