Pathology of urban problems from the perspective of legal violations of municipalities; from etiology to coping strategies
(Case study: Tabriz Municipality)

Legal disputes between citizens and municipalities, primarily arising from the extensive scope and volume of interactions between this institution and the public, have become one of the fundamental challenges in urban management. These disputes, sometimes stemming from violations committed by the municipality, have led to public dissatisfaction and the waste of the institution's valuable resources. Analyzing these violations is significant because their consequences extend beyond individual lawsuits, resulting in the infringement of citizens' rights and the erosion of public trust in governmental institutions. Accordingly, identifying the main instances of violations, analyzing the causes of their occurrence, and ultimately providing practical solutions for preventing and reducing these cases constitute an essential step toward improving urban management and realizing citizens' rights. The present study, with this approach and through a case-based examination, aims to explain the most significant violations by municipalities, their causes, and ultimately provide appropriate solutions. This research, employing a descriptive, analytical, and survey methodology, and gathering information through library and field studies, investigates cases brought before the Commission of Investigation and Inspection of the Tabriz City Council. By preparing questionnaires and conducting interviews with citizens in dispute with the municipality, it seeks to explain the important instances of legal violations by the Tabriz municipality, along with their causes and countermeasures. The findings of this research confirm that delays in processing cases and responding, non-enforcement of rulings by competent authorities, failure to fulfill commitments and settlements, and non-compliance with construction regulations are among the most significant instances of violations attributable to the municipality. Reforming and clarifying laws and regulations, establishing strong supervisory bodies, and securing municipal funding are the author's suggestions for reducing the municipality's legal violations.
