A Legal Pathology of Labor Relations System with Emphasis on the Labor Law of the Islamic Republic of Iran

| The Labor Law in Iran, as the main framework regulating the relationship between workers and employers, plays a significant role in safeguarding rights and balancing the interests of both parties. However, despite its importance, extensive criticisms have been raised in recent years regarding the effectiveness of this law and its ability to respond to ongoing economic and social changes. Accordingly, the present study was conducted with the aim of analyzing the vulnerabilities of the labor relations legal system and addresses the fundamental question: “What are the vulnerabilities of the labor relations legal system with an emphasis on the Labor Law of the Islamic Republic of Iran?” This study employed a qualitative approach based on a three-stage thematic analysis. The statistical population consisted of scholars and managers of organizations that play an active role in the labor relations legal system. Purposeful sampling was used to select participants, and based on the saturation principle, 19 semi-structured interviews were conducted. The data were analyzed using the three-stage thematic analysis approach with MAXQDA2020 software. According to the findings, a total of 45 basic themes, 13 organizing themes, and 3 overarching themes were identified. Based on the results, the vulnerabilities of the labor relations legal system, with an emphasis on the Iranian Labor Law, were classified into three categories: structural, behavioral, and contextual vulnerabilities. The study concludes that improving the effectiveness of the labor relations legal system requires a fundamental revision of the Labor Law, greater coherence among regulations, strengthened executive and supervisory mechanisms, and the expansion of social dialogue institutions in order to enhance justice, job security, and responsiveness to labor market developments. |
